Free Colorado Real Estate Power of Attorney Form

Among our various free forms on this website, we offer a free Colorado Real Estate Power of Attorney form.  This is a variety of a limited power of attorney, specifically used for one person to sign for another on a real estate contract, deed, or other closing documents.  This document must be recorded with the County land records (County Clerk and Recorder in Colorado) to give authority to the power of attorney.

Most title and escrow companies in Colorado will not accept a Colorado power of attorney from the seller to the buyer authorizing the buyer to sign the closing documents for the seller, particularly in a foreclosure situation or short sale.  Also, the principal (person giving the power of attorney) must usually be available by phone so the closing agent can call and verify that the principal is still alive and has not revoked the power of attorney.  Also, the person signing (called the "attorney-in-fact") will have to sign for the principal as follows, "John Smith by Perry Anderson as attorney-in-fact".
